Terms of Use

1. Introduction

Welcome to Rview (“we”, “us”, “our”), a platform available via website, iOS, and Android apps. Rview provides a marketplace for connecting users with reviewers. We do not directly provide review services but facilitate the transaction and communication between parties. (the “Service”).

By accessing or using Rview, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use our Service.


2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts in your jurisdiction. By using the Service, you confirm that you meet these requirements.


3. Services and Platform Use

  • Users may submit reviews of second-hand and/or new goods, including written comments, a checklist, and photos.
  • Users can request a product review by listing an item for evaluation via the rview process.
  • Users are encouraged to provide honest and constructive feedback on reviewers, as this helps maintain the quality and integrity of the service.
  • Reviewers agree to make a good faith effort to attend and complete any scheduled review appointments.
  • You agree to use the Service only for lawful purposes and in accordance with these Terms.
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.
  • Rview is a facilitation platform only. Rview does not guarantee the condition, value, or availability of items.

 

 4.Cancelations and refunds

4.1) Cancellation via the customer/lister

Customers may cancel a booked inspection as follows:

  • 24hr or more prior to inspection, full refund.
  • Less than 24hr prior, full refund minus service fee.
  • 2hr prior and during inspection, No refund.
  • Rview reserves the right to issue refunds at its discretion.
  • Service fee refers to the rview fee of 15%.
  • If a customer is dissatisfied with a completed review, they may submit a dispute/reconcile to Rview. Rview may offer a partial or full refund or a re-review. Decisions are at Rview’s discretion, taking into account the reviewer’s effort and the nature of the complaint. If the dispute cannot be resolved, the process in Section 13 applies.

 

4.2) Cancellation via the reviewer

If a reviewer cancels due to reasons within their control (eg: scheduling conflicts, illness):

  • 24hr or more prior to inspection, customer receives full refund.
  • Less than 24hr prior, customer receives full refund.
  • 2hr prior or during inspection, customer receives full refund.
  • If a reviewer is unable to complete the inspection due to reasons outside their control (eg: seller refusing access, the seller not being present, or the item being withdrawn from sale): then clause 4.3 (Cancellation via the Seller) will apply.
  • Rview reserves the right to issue refunds at its discretion.

 

4.3) Cancellation via the seller “third party sellers”

·If a third-party seller withdraws an item from sale, refuses inspection, or otherwise prevents completion of a booked inspection, Rview will refund the customer. Where an inspector has already incurred travel or time costs, Rview may deduct a call-out fee of up to 50% of the agreed inspection value. Rview is not responsible for cancellations or refusals made by third-party sellers

 

 

 

 


5. User Accounts

  • Users must meet the eligibility criteria (refer to section 2)
  • To use the Service, you must create an account. You agree to provide accurate and complete information and keep it updated.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
  • Rview may suspend or terminate your account at its sole discretion with or without notice, if you violate terms in section 8.
  • You are responsible for all activity under your account. You must notify Rview immediately if you become aware of any unauthorized use of your account or any security breach involving your credentials.
  • If you forget your password or lose access to your account, you may request assistance from Rview support to regain access.
  • You may not create multiple accounts to circumvent these terms or engage in prohibited conduct.
  • Upon termination, you may lose access to your account, bookings and any associated credits. Rview may return user content as required for legal or operational purposes.
  • Users may delete their account at any time via the “account management page”, Upon deletion, access to the account will cease and any remaining obligations will continue to apply.

6. Payments and Fees

  • Payments for review services are processed via Stripe. By using Stripe, you agree to their terms and privacy policy.
  • Prices for services may vary and are displayed at checkout. All payments are made in NZD or AUD depending on your location.
  • Payments are charged at the time of booking. Bookings are not confirmed until payment is successfully processed.
  • Payments to the reviewer are made via stripe once the review of the item has been completed and accepted by the customer “lister”,
  • Refunds for cancelled or failed inspections are subject to the policy in section 4.
  • If a payment fails or is declined, Rview reserves the right to cancel the booking.
  • You are responsible for any applicable taxes, fees, or surcharges.
  • Rview may apply reasonable additional fees (e.g. call-out fees) in accordance with section 4.3.
  • Rview charges a 15% incl GST commission fee on the total amount paid for each completed review. This fee is automatically deducted from the reviewer’s payment at the time of payout. By using the rview platform you agree to this commission structure.

 

 

 

 

7. User-Generated Content

  • By uploading or submitting content (text, checklist data, photos, etc.), you grant Rview a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the app or platform to provide the Service.
  • You confirm that:
    • You own or have the right to use all submitted content.
    • Your content does not violate any laws or infringe on any third-party rights.
    • Your content is accurate and not misleading.
  • Users are solely responsible for the content they submit, Rview may remove content at its discretion.

8. Prohibited Conduct

You agree not to:

  • Use the Service for illegal or fraudulent activities.
  • Impersonate any person or entity.
  • Submit false, misleading, or defamatory reviews.
  • Upload harmful or offensive content (including sexually explicit material, hate speech, or harassment).
  • Interfere with the platform’s operations or security.
  • Use bots or automated methods to interact with the service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. [Insert link to Privacy Policy]


10. Intellectual Property

All intellectual property rights in the platform, including our branding, software, and content (excluding user-submitted content), are owned by or licensed to Rview. You may not copy, modify, or distribute any part of the platform without our prior written consent.


 

 

11. Disclaimers

  • Rview does not guarantee the accuracy or completeness of reviews.
  • We are not liable for any damages or losses arising from reliance on user-submitted reviews.
  • The platform is provided "as-is" and "as-available" without warranties of any kind.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Rview is not liable for indirect, incidental, or consequential damages.
  • Our total liability for any claim arising out of or relating to these Terms or your use of the Service is limited to the amount you paid us (if any) during the 12 months prior to the claim.

13. Dispute Resolution

  • Users agree to first attempt informal resolution via Rview support.
  • If unresolved, mediation may be pursued before legal action.
  • Rview may mediate disputes and make recommendations but is not liable for outcomes.

14. Force Majeure

  • Rview is not liable for failure to perform obligations due to events beyond our reasonable control, including natural disasters, strikes, internet outages, system failures, or government restrictions.
  • In such cases, Rview may suspend or reschedule services without liability.

  

15. Inspector / Reviewer Liability

  • Reviewers act as independent agents providing inspections and opinions.
  • Rview is not responsible for injuries, damages, or losses during inspections.
  • Reviews reflect the reviewer’s observation at the time and do not guarantee item condition or value.

16. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, if you violate these Terms or engage in conduct harmful to the Service or others.


17. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or within the app. Continued use of the Service after changes take effect constitutes your acceptance.


18. Governing Law

These Terms are governed by the laws of:

  • New Zealand, for users residing in NZ;
  • Australia, for users residing in AUS.

Any disputes shall be resolved in the courts of your respective jurisdiction.
